DOJ Dismisses 3 Excise Tax Complaints vs. Discaya Couple

The Department of Justice (DOJ) has dismissed three excise tax complaints filed against contractors Curlee and Sarah Discaya and others in connection with several luxury vehicles.

According to DOJ spokesperson Polo Martinez, the excise tax liability does not fall on the Discaya couple because the importer is the one responsible for that aspect.

“Nakita po ng panel na hindi po importer sila Sarah at Curlee kaya hindi sila mananagot sa hindi pagbabayad ng excise tax. Ang may pananagutan po na magbayad ng excise tax ay ‘yung nag-import talaga. Kung hindi ninyo binili ang mga kotse,” ani Martinez.

The dismissed complaints involved a Land Rover/Range Rover and a Cadillac Escalade in one case, a Land Rover and a Mercedes-Benz in another case, and one Mercedes-Benz in a separate complaint.

These were part of the DOJ’s ongoing preliminary investigation into tax evasion complaints against the Discaya couple.

However, two other complaints are set to be filed by the DOJ before the Court of Tax Appeals.
